Non-career judges

NON-CAREER JUDGES (KNOWN AS MTTs) ARE NON-PROFESSIONAL JUDGES RECRUITED ON APPLICATION. THEY ARE APPOINTED FOR A RENEWABLE PERIOD OF 5 YEARS BY THE High Council for the Judiciary, THE CSM. ORGANIC LAW No. 2016-1090 OF 8 AUGUST 2016, WHICH CAME INTO FORCE ON 1 JULY 2017, MERGED TWO EXISTING GRADES OF JUDGE, THE local MAGISTRATE AND THE MTT. they ARE NOW COMPETENT TO RULE IN ALL CASES OVER WHICH THE DISTRICT JUDGE HAS JURISDICTION, EXCEPT FOR EMPLOYMENT TRIBUNAL CASES, AND ALSO TO SIT AS ASSESSORS AT THE REGIONAL COURT IN CIVIL AND CRIMINAL CASES. THESE non-career JUDGES ARE required TO TAKE THE TRAINING COURSES DELIVERED BY THE ENM.

AIMS

To keep up with the changes in their status and meet the training needs of MTTs, the sessions on offer deal with the professional techniques required to handle the cases which used to come under the jurisdiction of the local magistrates and are now handled by MTTs. They also cover the new areas of competence of these non-career judges: sitting on civil benches, exercising new competences taken over from the district judge, presiding over the police court for petty offences, etc.

TRAINING

Initial training – 10 days followed by an internship in a court
The ENM trains two groups of about a hundred MTTs each year. The theoretical teaching is completed by a probationary internship in a court lasting 40 to 80 days, although in certain circumstances this may be waived by the CSM.

In-service training – 5 days in the 1st  year and 3 days in the following years
MTTs can choose from about fifty different training courses. These may be designed specifically for them or they also be open to professional judges and other participants.
